of Allah, Most Gracious, Most Merciful.
All praise
and thanks are due to Allah, and peace and blessings be upon His Messenger.
Dear
brother in Islam, we would like to thank you for showing keenness on learning the
teachings of Islam, and we appreciate the great confidence you have in us. We hope our
efforts meet your expectations, yet we apologize for the late reply.
As regard
your question, Sheikh Hamed Al-`Ali, instructor of Islamic Heritage at the Faculty of
Education, Kuwait and Imam of Dahiat As-Sabahiyya Mosque, answers:
Whoever
commits a major sin is to be treated as a Muslim because a Muslim is not regarded as Kafir
(disbeliever) for committing major sins. However, we should advise this person, guide him
to the straight path, and warn him against the consequences of committing sins.
However, if
you see that staying away from him will benefit in making him give up the sins he is
committing, when he gets to know that one of his dear friends has left him because of the
sins he is committing and cannot tolerate you staying away from him, then you may stay
away from him for a period of time. But if staying away from him will not benefit him,
then you should advise him and try as much as you can to put him back on the right
track.
Sheikh
Muhammad Iqbal Nadvi, Imam of Calgary Mosque, Canada, and Former Professor at King Saud
Univ., Saudi Arabia, adds:
Basically,
what is to be understood here is that Kufr is a matter of faith. The sins cited here are
related to the practice of faith. Thus, anyone who commits these sins is still called a
Muslim. Only when he denies faith in Allah the Almighty, he can be branded disbeliever.
The duty of
other Muslims towards such a person who commits all these sins is to spare no pains in
trying to correct and advise him to avoid committing such major and heinous sins. Another
thing is that the advice should be offered in private, not in public. Thus, you should
commit yourself to bringing this person back to the right track by kind advice.

Not once did Osama deny his
faith in Allah, NOT ONCE. How could Osama deny his faith in Allah when he has a website to
defend Islam? So hence Jalal is very wrong for saying what he did.
Secondly,
Jalal has taken comments from Osama which are old comments, basically what Jalal did is
take Osama's comments out of time-content, therefore he is guilty of intentionally giving
a false impression. Secondly, even Jalal knew this, that Osama removed many of those
claims Jalal attacked him for, yet he still calls Osama a kaffir and apostate. Therefore
this hadith applies to Jalal:
Volume 8,
Book 73, Number 71:
Narrated Abu Dhar:
That he heard the Prophet saying,
"If somebody accuses another of Fusuq (by calling him 'Fasiq' i.e. a wicked person)
or accuses him of Kufr, such an accusation will revert to him (i.e. the accuser) if his
companion (the accused) is innocent."(
Sahih Bukhari)
This hadith
applies to Jalal, since Osama is innocent of the claims Jalal is making, Osama has REMOVED
those articles he had, and repented, and admitted his wrong. So hence what Jalal accuses
Osama off will simply fall back on him, this means that it will be Jalal who becomes the
apostate. So Jalal must repent of his wrong statements against Osama. Osama has repented
of his mistakes, and he even showed this in his response to Jalal by quoting all the
emails. As Allah says, he accepts those who repent to him and he is the most merciful:

Then learnt Adam from his Lord words of inspiration, and his Lord Turned towards him; for
He is Oft-Returning, Most Merciful.
004.096
YUSUFALI:
Ranks specially bestowed by Him, and Forgiveness and Mercy. For Allah is Oft-forgiving,
Most Merciful.
007.153
YUSUFALI: But those who do wrong but
repent thereafter and (truly) believe,- verily thy Lord is thereafter Oft-Forgiving, Most
Merciful.
Here are some other hadiths:
Volume 1, Book 2, Number 21:
Narrated Abu Said Al-Khudri:
The Prophet said, "When the
people of Paradise will enter Paradise and the people of Hell will go to Hell, Allah will
order those who have had faith equal to the weight of a grain of mustard seed to be taken
out from Hell. So they will be taken out but (by then) they will be blackened (charred).
Then they will be put in the river of Haya' (rain) or Hayat (life) (the Narrator is in
doubt as to which is the right term), and they will revive like a grain that grows near
the bank of a flood channel. Don't you see that it comes out yellow and twisted"
Even those people with faith equal the size of a mustard seed will go to heaven! Yet Jalal
is accusing Osama of being an apostate, when Osama defends Islam and has been doing so for
several years, and Osama has even more faith than a mustard seed.
Lastly, who
made Jalal a judge to declare someone an apostate or not? This is his own arrogance and
ignorance that he has now taken it upon himself to declare people kafirs or not.
