according to verse (5-5) wedlock must happen and we are not even allowed to take a mistresses according to that verse . so she is a prophet wife and one of our mothers if she was really one of his women.
and sure you know that no one are allowed to marry his mother because his wives are our mothers as Allah almighty mentioned in Verse (33:6), so what about concubines/right hand possess are they wives? if mother Maria was just a concubine not wedlocked by maybe a different Nikah contract then Verse (33:6) can let us marry mother Maria because Muhammad PBUH is not a father of any of us according to (33:40). and we didn't heard that there is someone have been married mother Maria after the prophet's time. النكاح في اللغة: يكون بمعنى عقد التزويج و يكون بمعنى وطء الزوجة قال أبو علي القالي: (فرقت العرب فرقا لطيفا يعرف به موضع العقد من الوطء، فإذا قالوا: نكح فلانة أو بنت فلان أرادوا عقد التزويج، وإذا قالوا: نكح امرأته أو زوجته لم يريدوا إلا الجماع و الوطء)).
ومعنى النكاح في الشرع: (( تعاقد بين رجل و امرأة يقصد به استمتاع كل منهما بالآخر و تكوين أسرة صالحة و مجتمع سليم)).
ومن هنا نأخذ انه لا يقصد بعقد النكاح مجرد الاستمتاع بل يقصد به مع ذلك معنى آخر هو ( تكوين الأسرة الصالحة و المجتمعات السليمة لكن قد يغلب احد القصدين على الآخر لاعتبارات معينة بحسب أحوال الشخص.
احزاب 49 "يَا أَيُّهَا الَّذِينَ آمَنُوا إِذَا نَكَحْتُمُ الْمُؤْمِنَاتِ ثُمَّ طَلَّقْتُمُوهُنَّ مِنْ قَبْلِ أَنْ تَمَسُّوهُنَّ فَمَا لَكُمْ عَلَيْهِنَّ مِنْ عِدَّةٍ تَعْتَدُّونَهَا ۖ فَمَتِّعُوهُنَّ وَسَرِّحُوهُنَّ سَرَاحًا جَمِيلًا "

NIKAH in the language: a sense of holding marriages contract and have the sense of intercourse, Abu Ali Frier said: (Arabs pleasantly dispersed of subject between marriage of intercourse, if they said Nakah someone a girl so and so wanted to hold marriages contracts, and if they say: Nakah someone his wife did only want to mean intercourse)).
The meaning of NIKAH in Islam: ((a contract between a man and a woman intended to enjoy each other and family formation are valid and healthy society)).
Hence, we take it is not intended of word NIKAH to just to enjoy , however, another meaning is (valid family formation and healthy communities but one meaning may tend on certain other considerations, according to the conditions of the person.

"O ye who believe! When ye marry(NAKAH-TOM) believing women, and then divorce them before ye have touched them, no period of 'Iddat have ye to count in respect of them: so give them a present. And set them free in a handsome manner."
here NIKAH also came as marriage contract.
